enTouch Wireless Affordable Connectivity Program (ACP) Terms & Conditions

These Terms and Conditions govern your participation in the Affordable Connectivity Program (ACP), and include required disclosures and eligibility information. Our standard terms and conditions, including the Acceptable Use Policy (AUP), also apply and are available at www.entouchwireless.com/terms-of-service. The ACP is a government benefit program operated by the Federal Communications Commission (FCC) that provides discounts on monthly broadband Internet access service and certain connected devices. The ACP provides discounts of up to $30 per eligible household on monthly broadband Internet access service (or up to $75 per eligible household on Tribal lands) and up to $100 on certain connected devices (with a required co-pay of between $10.01 and $49.99). The ACP monthly service and device discounts cannot be transferred to another household or individual. An eligible household is limited to one monthly service discount and a single, one-time device discount. ACP benefits may be obtained from any participating provider of your choosing and your monthly service benefit may be transferred to another provider at any time. ACP services and devices are subject to consumer eligibility, provider participation, product availability, and approval by the FCC/Universal Service Administrative Company (USAC). The ACP was launched on December 31, 2021, and replaces the Emergency Broadband Benefit (EBB) program. Subscribers enrolled in the EBB as of December 31, 2021 may keep their EBB benefit for 60 days and must transition to the ACP on March 1, 2022, if eligible. 

You may opt-in for the ACP at the time of enrollment with enTouch Wireless or anytime thereafter through the self-service tool. Existing customers can also opt-in by replying to an opt-in SMS. By opting in, you are selecting enTouch Wireless as your ACP service provider and agree to these ACP Terms and Conditions.

By subscribing to enTouch Wireless’s ACP supported services, you authorize enTouch Wireless and its contracted partners, for the purpose of applying for, determining eligibility, enrolling in and seeking reimbursement of ACP service and device benefits, to collect, use, share and retain your personal information, including, but not limited to, information required for the purpose of establishing eligibility for and enrolling in the ACP program, and including, but not limited to, full name, full residential address, date of birth, last four digits of social security number, telephone number, eligibility criteria and status, the date on which the ACP service discount was initiated and, if applicable, terminated, ACP connected device distribution date/type/make and model/status, usage status and other compliance requirements, the amount of support being sought for the service and/or device, and information necessary to establish identity and verifiable address. This includes sharing the information with USAC to ensure proper administration of the ACP service and/or connected device benefits. Failure to provide consent will result in your being denied the ACP service and/or the connected device benefits.

You agree that any state, local, Tribal government, school, or school district may share information about your receipt of benefits that would establish eligibility for the ACP and that such information will be used only to determine ACP eligibility.

enTouch Wireless and its contracted partners may contact you to validate your eligibility for or desire to participate in enTouch Wireless’s ACP offers and other products and services via email, telephone, or text messaging. Text messaging and data rates may apply. Consent for calls and texts is optional and can be revoked at any time.

Eligibility

A household is eligible to receive an ACP discount if a member of the household meets one of the criteria below:

  • Has an income that is at or below 200% of the Federal Poverty Guidelines for a household of that size;
  • Receives benefits from certain federal assistance programs: Medicaid, Supplemental Nutrition Assistance Program (SNAP), Supplemental Security Income, Federal Public Housing Assistance, Veterans and Survivors Pension Benefit, Special Supplemental Nutritional Program for Women, Infants and Children (WIC) Program, or Lifeline;
  • Is approved to receive benefits under the free and reduced-price school lunch program or the school breakfast program;
  • Received a Federal Pell Grant during the current award year; or
  • Meets the eligibility criteria for a participating provider’s qualifying low-income program.

 

Households residing on Tribal Lands are additionally eligible to receive an ACP discount if a member of the household meets one of the criteria below:

  • Receives Bureau of Indian Affairs General Assistance;
  • Participates in Head Start (only households meeting the income qualifying standard);
  • Receives Tribal Temporary Assistance for Needy Families (Tribal TANF); or
  • Participates in the Food Distribution Program on Indian Reservations.

ACP eligibility will be determined for the FCC by USAC’s National Verifier and National Lifeline Accountability Database, or an alternative verification process approved by the FCC.

Service Plans

You can apply your ACP discount to any available enTouch Wireless service plan.

  • Non-Tribal (CA) ACP Only Plan: Unlimited Talk, Unlimited Text, and 8GB Data
  • Tribal (Non-CA) ACP Only Plan: Unlimited Talk, Unlimited Text, and 15.5GB Data
  • Non-Tribal (Other, excludes OR, KY, PR) ACP Only Plan: Unlimited Talk, Unlimited Text, and 5.5GB Data*
  • Non-Tribal (KY) ACP Only Plan: Unlimited Talk, Unlimited Text, and 6.5GB Data*

*Service plans include up to the first 6 GBs of data (or lesser allotment designated in plan) at up to 1 Mbps, remaining data up to the designated service plan allotment at up to 512 kbps, and for Unlimited plans only, unlimited data above the service plan allotment at up to 256 kbps. Data usage requires a data-capable device, and is subject to our Acceptable Use Policy (AUP), available in our Terms of Service. CA subscribers on the free combination CA Tribal Lifeline + ACP plan with Unlimited Talk & Text + Unlimited Data will receive an allocation of 25 GBs of data. CA subscribers on the free combination Non-Tribal Lifeline + ACP plan with Unlimited Talk & Text + Unlimited Data will receive an allocation of 14 GBs of data. Subscribers in states other than CA on the combination Tribal Lifeline + ACP plan with Unlimited Talk & Text + Unlimited Data will receive an allocation of 23 GBs of data. Customers on any Unlimited service plans using data consistent with the AUP may receive unlimited additional free data in 500 MB increments (at 256 kbps) for the rest of the monthly period by contacting Customer Care. Video typically streams in SD (480p).  Lower speeds may affect audio and video streaming, access to certain websites and content, or use of available applications. For any Unlimited service plan, customers who exceed 23 GBs of data usage (or 25 GBs in CA only)  in a monthly period, data service may be placed on hold to confirm usage complies with our AUP. Subscribers in states other than California who subscribe to a combined non-tribal Lifeline and ACP service offering and later transfer out their ACP benefit will be automatically transferred to a Lifeline plan that includes 1000 minutes, 500 texts, and 100 MBs of data at 1Mbps.
California subscribers who subscribe to a combined non-tribal Lifeline + ACP plan and transfer out their ACP benefit will be automatically transferred to a Lifeline plan that includes 6 GBs of data. California voice-only Lifeline subscribers must acquire a data capable device in order to subscribe to an ACP-supported service plan.

Broadband Speeds

Your service plan terms and conditions may limit the amount of high-speed data included with your service plan and the actual speeds you will achieve while using our broadband services. Other factors, including your device, network availability from our underlying carrier, your proximity to cellular towers, and environmental factors may affect speeds. Lifeline Subscribers

Customers may have one ACP and one Lifeline benefit per household. Your Lifeline benefit and ACP can be combined and applied to the same service plan or applied to different service plans. You are not required to opt-in to the ACP, and you can continue to receive your Lifeline service without enrolling in the ACP. You may choose to take ACP benefits from a service provider other than your existing Lifeline provider. Emergency Broadband Benefit Subscribers

This Agreement applies to subscribers who are enrolled in enTouch Wireless’s EBB services. The FCC is phasing out the EBB and replacing it with the ACP beginning on December 31, 2021. Eligible subscribers who are enrolled in enTouch Wireless’s EBB Services as of 6:00 PM Eastern Time on December 30, 2021, will continue to receive Services with their EBB program discount of up to $50 (or for households on Tribal lands, up to $75) per month during a 60-day transition period, which lasts from December 31, 2021 to March 1, 2022. The discount amount available to subscribers who are enrolled in the ACP after the transition period will be up to $30 per month. Beginning December 31, 2021, EBB customers may switch their service plan at any time. EBB subscribers who qualified for the EBB through eligibility criteria that are not applicable to the ACP will be required by USAC to demonstrate their eligibility in the National Verifier to receive an ACP benefit using the ACP criteria before the end of the transition period. EBB subscribers will receive additional information if they are required to take additional steps to transition to the ACP benefit on March 1, 2022.

Account Activity Requirement

To continue receiving your ACP service with enTouch Wireless, you must make or answer a voice call or send a text message (if your device is capable), use data, purchase minutes, or respond to direct contact from enTouch Wireless at least once during any 30-day period.

ACP Discontinuance

If the FCC announces that funding for the ACP has been exhausted, we discontinue our ACP service offers, or we determine you are no longer eligible for the ACP, we will notify you and your ACP benefits will end.   If you are enrolled in both Lifeline and ACP with enTouch Wireless, then you may revert to our standard FREE Lifeline plan where available and if you are eligible. You may choose to keep your service plan or choose another plan available at the time, but you will be subject to paying applicable rates plus applicable fees and taxes. What is the Affordable Connectivity Program or ACP?

Who is eligible for ACP discounts on broadband service?

The ACP shares the same qualifying program based eligibility criteria as the Federal Lifeline program, including participation in CalFresh / SNAP, Medi-Cal / Medicaid, SSI, Federal Public Housing Assistance, and Veterans and Survivors Pension Benefit Fund. Additional eligibility criteria are unique to ACP and do not qualify for Lifeline, including Pell Grants (current award year recipients), Free and Reduced Price School Lunch and Breakfast (including through the USDA Community Eligibility Provision),  WIC Program, and income at or below 200% of the federal poverty level. ACP eligibility will be determined for the FCC by USAC’s National Verifier and National Lifeline Accountability Database, or an alternative verification process approved by the FCC.

What rules apply to me when I participate in the program?

Only eligible consumers may receive ACP discounts. The ACP monthly service and device discounts cannot be transferred to another household or individual. An eligible household is limited to one monthly service discount and one device discount. ACP discount recipients must either make or answer a voice call message (if your device is capable), send a text message (if your device is capable), use data, purchase minutes, or respond to direct contact from us at least once during any 30-day period to continue receiving your ACP service.

If I already receive Lifeline benefits, will I automatically receive the ACP benefit?

No. You must opt-in and choose an eligible ACP service plan. Lifeline plans and benefits may be maintained without enrolling in the ACP. If you want to apply for ACP service only, please call 888-294-9465. If you’re a customer that did not qualify for Lifeline based on a federal program, you will need to apply for ACP eligibility at https://acpbenefit.org/.

Can I choose my ACP provider?

ACP benefits may be obtained from any participating provider of your choosing and your monthly service benefit may be transferred to another provider at any time.

How is Lifeline different from the ACP?

Lifeline is the FCC’s permanent program to support affordable access to essential communications services such as broadband Internet access. The ACP is a new program designed to provide additional support to make broadband more affordable for struggling households. Your Lifeline and ACP benefits can be combined and applied to the same service plan or applied to different service plans. If I enrolled in the EBB Program, will I continue to receive my EBB discount?

The FCC is phasing out the EBB and replacing it with the ACP beginning on December 31, 2021. What download and upload speeds will I receive?

enTouch Wireless provides high-speed broadband service to ACP customers. Your service plan terms and conditions may limit the amount of high-speed data included with your service plan and the actual speeds you will achieve while using our broadband services. Maximum speeds are optimal for real-time or near real-time, high-bandwidth uses, but lower speeds may affect your ability to stream audio and video, access certain websites and content, or interact with available applications. Other factors, including your device, network availability from our underlying carrier, your proximity to cellular towers, and environmental factors, may affect speeds. How long will the ACP last?

The ACP benefit is subject to funding availability from the FCC, provider participation, and consumer eligibility. If the FCC announces that funding has been exhausted, we discontinue our ACP service offers, or we determine you are no longer eligible for the ACP, we will notify you and your ACP benefits will end.  If you are enrolled in both Lifeline and ACP with enTouch Wireless, then you may revert to our standard FREE Lifeline plan where available and if you are eligible. You may choose another service plan by paying the applicable undiscounted rate for any of our plans available at that time plus applicable fees and taxes. Our terms and conditions will apply.
